Welcome to OrchestraCommunity. By accessing or using our platform, you agree to be bound by these terms. Our mission is to provide a centralized platform for musicians to find orchestras and for administrators to manage their rosters and communicate securely.
By creating an account, you agree to these Terms of Service and our Privacy Policy. This service is designed to foster collaborative music-making and enhance social well-being through shared artistry.
Authentication: We use a passwordless system via Supabase, supporting Google, Discord, and Magic Links.
User Responsibilities: You are responsible for maintaining the security of your third-party login credentials.
Account Roles: Your access level and permissions within an organization are determined by a dynamic Role-Based Access Control (RBAC) model.
Verification: All new Organizations and Orchestras are subject to an automated audit using the Gemini API to verify authenticity based on provided website and social links.
Administrative Approval: Final approval for any organization to join the platform rests with our system administrators.
Membership: Individual orchestra management is responsible for verifying and managing their own members.
Safe Environment: Users must communicate respectfully within the communities chat rooms.
Content Restrictions: The posting of scams or malicious content is strictly prohibited.
URL Whitelisting: To protect the community, users may only embed external links that have been approved through our Whitelisted URL system.
Monitoring: We maintain system logs to track administrative and user actions for auditing and security purposes only.
Content Ownership: You retain ownership of the musical information and personal details you provide.
AI Usage: We use AI solely for the purpose of administering and automating the system. We do not use your personal information, communications or creative content to train AI models, and never will.
Mapping Services: Public orchestra locations are displayed using Google Maps.
Availability: While we strive for constant uptime to support your musical activities, we do not guarantee uninterrupted service. The service is hosted on managed Google Cloud infrastructure for maximum update and reliability.
Modifications: We reserve the right to update these terms to reflect changes in our tech stack or community guidelines.
We reserve the right to suspend or terminate accounts that violate these terms, engage in deceptive practices during the audit process, or post unapproved/malicious content.
1. "As-Is" Service: OrchestraCommunity (OC) provides a digital platform "as is." We do not guarantee 100% uptime, nor do we warrant that the platform will be free of bugs or data errors. Users are responsible for maintaining their own backups of any community data, scores, or schedules uploaded to the platform.
2. Liability Cap: To the maximum extent permitted by the Australian Consumer Law (ACL), the total liability of OC Pty Ltd for any claim (whether in contract, tort, or negligence) arising out of a service failure or data breach is limited to:
The total amount paid by the User to OC in the 6 months preceding the claim; or
AUD $100.00 (whichever is greater).
3. Exclusion of Consequential Loss: OC Pty Ltd is not liable for indirect losses, including but not limited to loss of ticket revenue, venue hire costs, or reputational damage resulting from platform downtime or data loss.
4. Data Breach: While OC employs industry-standard security (MFA, Encryption), the User acknowledges that no internet-based service is 100% secure. OC's liability for data incidents is limited to its statutory obligations under the Privacy Act 1988 (Cth).
